Bahkan pasca pandemi pun, ombak layoff masih terjadi di berbagai perusahaan. Ini adalah langkah drastis yang harus diambil perusahaan untuk menyesuaikan kondisi bisnis, efisiensi, karena pandemi atau resesi. Di Indonesia, proses layoff massal tidak hanya memberi dampak sosial, tetapi juga memiliki konsekuensi hukum yang serius. Oleh karena itu, sangat penting untuk memahami kewajiban perusahaan ketika layoff massal, agar dapat menyikapi dan menindaklanjutinya dengan benar. Ini berlaku baik untuk karyawan yang terdampak maupun perusahaan yang melakukan layoff massal. Artikel ini akan mengupas tentang kewajiban perusahaan ketika layoff massal, termasuk aturan dan konsekuensi hukum jika kewajiban tersebut tidak terpenuhi.<\/p>\n\n\n\n<p><strong>Dasar Hukum Layoff Massal di Indonesia<\/strong><\/p>\n\n\n\n<p>Secara hukum, PHK diatur dalam Undang-Undang Nomor 13 Tahun 2003 tentang Ketenagakerjaan, yang kemudian direvisi melalui UU Cipta Kerja (UU No. 11 Tahun 2020) dan peraturan pelaksananya seperti Peraturan Pemerintah (PP) No. 35 Tahun 2021. Pemberitahuan ini harus menjelaskan alasan PHK, waktu pelaksanaan, serta hak-hak yang akan diterima oleh karyawan. Jika perusahaan tidak memberitahukan dengan cukup waktu, maka pekerja dapat dianggap tetap bekerja dan berhak atas gaji.<\/p>\n\n\n\n<p>Mengenai kompensasi, kewajiban perusahaan telah diatur secara detail dalam undang-undang.<strong> <\/strong>Menurut PP No. 35 Tahun 2021, ketika melakukan PHK massal, perusahaan wajib memberikan kompensasi yang terdiri dari:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Uang pesangon<\/strong>: sesuai masa kerja karyawan.<\/li>\n\n\n\n<li><strong>Uang penghargaan masa kerja (UPMK)<\/strong>: untuk pekerja yang telah bekerja lebih dari 3 tahun.<\/li>\n\n\n\n<li><strong>Uang penggantian hak<\/strong>: mencakup hak cuti yang belum diambil, biaya pemulangan, dan fasilitas lain.<\/li>\n<\/ul>\n\n\n\n<p>Adapun jika karyawan tergabung dalam serikat pekerja, maka perusahaan wajib melakukan perundingan bipartit terlebih dahulu. Perundingan ini bertujuan mencapai kesepakatan atas rencana layoff dan hak-hak pekerja.
