Sehingga demi melindungi karyawan, pemerintah telah menetapkan peraturan yang jelas tentang hak-hak karyawan di-PHK melalui Undang-Undang Ketenagakerjaan dan peraturan-peraturan turunannya. Artikel ini akan mengulas secara mendalam hak-hak karyawan di-PHK, terutama bagi karyawan tetap, termasuk prosedur dan kompensasinya.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Prosedur PHK<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Menurut Undang-Undang Nomor 13 Tahun 2003 tentang Ketenagakerjaan, PHK tidak bisa dilakukan secara sepihak oleh perusahaan tanpa alasan yang sah. Prosedur PHK pun harus mengikuti beberapa tahap:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li><strong>Pemberitahuan<\/strong>: Perusahaan harus memberitahu karyawan mengenai rencana PHK secara tertulis dan menjelaskan alasan di balik keputusan tersebut. Pemberitahuan ini harus diberikan setidaknya 30 hari sebelum tanggal PHK yang direncanakan.<\/li>\n<\/ol>\n\n\n\n<ol start=\"2\" class=\"wp-block-list\">\n<li><strong>Negosiasi<\/strong>: Jika karyawan menolak keputusan PHK, perusahaan dan karyawan harus mengadakan perundingan bipartit untuk mencari solusi yang menguntungkan kedua belah pihak. Jika negosiasi ini tidak mencapai kesepakatan, maka kasus PHK dapat dibawa ke Dinas Tenaga Kerja untuk mediasi.<\/li>\n<\/ol>\n\n\n\n<ol start=\"3\" class=\"wp-block-list\">\n<li><strong>Penyelesaian Perselisihan<\/strong>: Jika mediasi juga tidak berhasil, kasus tersebut dapat dibawa ke Pengadilan Hubungan Industrial untuk mendapatkan keputusan yang mengikat secara hukum.<\/li>\n<\/ol>\n\n\n\n<p class=\"wp-block-paragraph\"><strong><a href=\"https:\/\/www.gaji.id\/id\/2024\/07\/07\/ini-yang-harus-dilakukan-saat-mengalami-phk-sepihak\/\">Baca Juga: Ini Yang Harus Dilakukan Saat Mengalami PHK Sepihak<\/a><\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Hak-hak Karyawan yang Di-PHK<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Berdasarkan undang-undang, karyawan tetap yang di-PHK berhak mendapatkan kompensasi berupa uang pesangon dan\/atau Uang Penghargaan Masa Kerja (UPMK), serta Uang Penggantian Hak (UPH). Berikut adalah ketentuan mengenai kompensasi tersebut:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li><strong>Uang Pesangon<\/strong><\/li>\n<\/ol>\n\n\n\n<p class=\"wp-block-paragraph\">Besaran uang pesangon yang harus diberikan perusahaan dihitung berdasarkan masa kerja karyawan, sebagai berikut:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Masa kerja kurang dari 1 tahun: 1 bulan upah<\/li>\n\n\n\n<li>Masa kerja 1 &#8211; 2 tahun: 2 bulan upah<\/li>\n\n\n\n<li>Masa kerja 2 &#8211; 3 tahun: 3 bulan upah<\/li>\n\n\n\n<li>Masa kerja 3 &#8211; 4 tahun: 4 bulan upah<\/li>\n\n\n\n<li>Masa kerja 4 &#8211; 5 tahun: 5 bulan upah<\/li>\n\n\n\n<li>Masa kerja 5 &#8211; 6 tahun: 6 bulan upah<\/li>\n\n\n\n<li>Masa kerja 6 &#8211; 7 tahun: 7 bulan upah<\/li>\n\n\n\n<li>Masa kerja 7 &#8211; 8 tahun: 8 bulan upah<\/li>\n\n\n\n<li>Masa kerja 8 tahun atau lebih: 9 bulan upah<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\"><strong><a href=\"https:\/\/www.gaji.id\/id\/2023\/11\/16\/panduan-dan-contoh-surat-pemberhentian-kerja\/\">Baca Juga: Panduan dan Contoh Surat Pemberhentian Kerja<\/a><\/strong><\/p>\n\n\n\n<ol start=\"2\" class=\"wp-block-list\">\n<li><strong>Uang Penghargaan Masa Kerja<\/strong><\/li>\n<\/ol>\n\n\n\n<p class=\"wp-block-paragraph\">Selain uang pesangon, karyawan juga berhak atas uang penghargaan masa kerja, yang dihitung sebagai berikut:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Masa kerja 3 &#8211; 6 tahun: 2 bulan upah<\/li>\n\n\n\n<li>Masa kerja 6 &#8211; 9 tahun: 3 bulan upah<\/li>\n\n\n\n<li>Masa kerja 9 &#8211; 12 tahun: 4 bulan upah<\/li>\n\n\n\n<li>Masa kerja 12 &#8211; 15 tahun: 5 bulan upah<\/li>\n\n\n\n<li>Masa kerja 15 &#8211; 18 tahun: 6 bulan upah<\/li>\n\n\n\n<li>Masa kerja 18 &#8211; 21 tahun: 7 bulan upah<\/li>\n\n\n\n<li>Masa kerja 21 &#8211; 24 tahun: 8 bulan upah<\/li>\n\n\n\n<li>Masa kerja 24 tahun atau lebih: 10 bulan upah<\/li>\n<\/ul>\n\n\n\n<ol start=\"3\" class=\"wp-block-list\">\n<li><strong>Uang Penggantian Hak<\/strong><\/li>\n<\/ol>\n\n\n\n<p class=\"wp-block-paragraph\">Karyawan juga berhak menerima uang penggantian hak, yang mencakup:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Cuti tahunan yang belum diambil dan belum gugur<\/li>\n\n\n\n<li>Biaya atau ongkos pulang untuk karyawan dan keluarganya ke tempat di mana karyawan diterima bekerja<\/li>\n\n\n\n<li>hal-hal lain yang ditetapkan dalam perjanjian kerja, peraturan perusahaan, atau perjanjian kerja bersama.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\"><strong><a href=\"https:\/\/www.gaji.id\/id\/2024\/03\/05\/cut-off-adalah-pengertian-skema-dan-cara-menghitungnya\/\">Baca Juga: Cut Off, Pengertian, Skema, dan Cara Menghitungnya<\/a><\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Jadi hak karyawan di-PHK telah diatur secara menyeluruh dalam peraturan perundang-undangan di Indonesia. Karyawan yang merasa haknya dilanggar dan tidak berhasil mencapai kesepakatan dengan perusahaan dapat mengajukan gugatan ke Pengadilan Hubungan Industrial. Pengadilan ini khusus menangani perselisihan hubungan industrial, termasuk sengketa PHK.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Dapat dikatakan bahwa PHK adalah proses yang harus dilakukan dengan sangat hati-hati dan sesuai peraturan yang berlaku di Indonesia. Hak karyawan di-PHK harus dihormati dan dipenuhi oleh setiap perusahaan yang merencanakan PHK.
