Apakah perusahaan melanggar hukum jika tidak memberikannya? Akan tetapi, Peraturan Pemerintah (PP) Nomor 19 Tahun 2016 mengatur tentang gaji ke-14 bagi pejabat negara, PNS, penerima tunjangan pensiun, serta anggota TNI dan Polri. Hal ini juga didukung oleh PP Nomor 24 Tahun 2017 terkait gaji ke-14.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Perusahaan asing atau swasta tidak terkena peraturan terkait gaji ke-14, tetapi peraturan terkait upah tambahan mengacu pada Peraturan Menteri Tenaga Kerja (Permenaker) Nomor 6 Tahun 2016 serta PP Nomor 78 Tahun 2015 tentang upah. Dalam Permenaker dan PP ini, terdapat ketentuan untuk pemberian upah tambahan berupa tunjangan hari raya (THR).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Tidak seperti THR, bonus tahunan bukanlah sesuatu yang diwajibkan. Akan tetapi, jika perusahaan secara spesifik menyantumkannya di perjanjian kerja, perusahaan akan dianggap melanggar hukum jika tidak memberikannya kepada pegawai.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Baca Juga : <a href=\"https:\/\/www.gaji.id\/en\/contoh-soal-pph-pasal-21-beserta-jawaban-dan-penjelasannya\/\"><strong>Contoh Soal PPH 21<\/strong><\/a><\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Jumlah Standar Tunjangan Hari Raya<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">THR memiliki ketentuan terkait jumlah. Pasal 3 Ayat 1 dari Peraturan Menteri menyebut ketentuan jumlah THR sebagai berikut:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li><strong>Setara sebulan gaji<\/strong><\/li><\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">THR sebesar minimal sebulan gaji wajib diberikan kepada pegawai yang telah memiliki masa kerja selama 12 bulan berturut-turut, tanpa putus.<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li><strong>Jumlah THR proporsional<\/strong><\/li><\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Pegawai yang masa kerjanya belum mencapai 12 bulan juga berhak mendapat THR, tetapi jumlahnya dihitung secara proporsional berdasarkan lama kerjanya.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Menurut PP Nomor 78 Tahun 2015, terdapat sanksi administratif bagi perusahaan yang ketahuan tidak memberi THR (atau memberi THR dengan jumlah lebih sedikit dari seharusnya). Sanksi bisa terdiri dari surat teguran, pembatasan aktivitas bisnis, penghentian sementara kegiatan atau alat produksi, hingga pembekuan usaha.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Menghitung Bonus Tahunan untuk Karyawan<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Walau bonus tahunan tidak diwajibkan, banyak perusahaan yang menyantumkannya dalam perjanjian kerja. Hal ini biasanya dianggap sebagai investasi, yaitu untuk memotivasi karyawan serta meningkatkan loyalitas.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Tidak ada ketentuan khusus untuk menghitung jumlah bonus, karena memang tidak ada di dalam undang-undang. Akan tetapi, perusahaan harus menggunakan rumus yang adil untuk menghindari kecemburuan. Secara umum, bonus tahunan bisa dihitung menggunakan rumus ini:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li><strong>Menurut masa kerja<\/strong><\/li><\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Untuk karyawan yang sudah bekerja selama satu hingga dua tahun, jumlah bonus adalah 90 persen gaji. Masa kerja tiga hingga empat tahun mendapat 100 persen. Lima hingga enam tahun mendapat 110 persen. Tujuh hingga delapan mendapat 120 persen. Delapan hingga sembilan mendapat 130 persen. Sepuluh tahun ke atas mendapat 140 persen.<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li><strong>Menurut departemen<\/strong><\/li><\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Departemen produksi biasanya mendapat bonus tahunan sebesar 120 persen gaji. Departemen nonproduksi mendapat 110 persen, dan pendukung mendapat 100 persen.<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li><strong>Menurut tingkat jabatan<\/strong><\/li><\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Pegawai dari jabatan tingkat terendah seperti operator atau petugas pelaksana mendapat 80 persen gaji untuk bonus.
