Padahal soal jam kerja sudah diatur jelas dalam UU Ketenagakerjaan dan UU Ciptaker. Karena itu, memahami aturan jam kerja menurut UU Ciptaker menjadi fondasi penting bagi manajemen SDM yang bertanggung jawab. Regulasi ini bukan sekadar formalitas hukum, melainkan panduan nyata untuk melindungi hak dan produktivitas karyawan. Bagi tim HR, regulasi tersebut menjadi acuan utama dalam menyusun kebijakan absensi dan penggajian.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">UU Cipta Kerja disahkan pada Oktober 2020 dan merevisi sejumlah ketentuan dalam UU Ketenagakerjaan No. 13 Tahun 2003. Salah satu aspek yang ikut diperbarui adalah pengaturan waktu kerja, lembur, dan hak istirahat karyawan. Perubahan ini dirancang untuk memberikan fleksibilitas bagi dunia usaha, dengan tetap melindungi kesejahteraan dan kesehatan tenaga kerja.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Ketentuan Dasar Jam Kerja<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Aturan jam kerja menurut UU Ciptaker menetapkan dua sistem waktu kerja yang dapat dipilih perusahaan, yaitu:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Sistem 6 hari kerja: 7 jam per hari, total 40 jam per minggu.<\/li>\n\n\n\n<li>Sistem 5 hari kerja: 8 jam per hari, total 40 jam per minggu.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Perusahaan bebas menentukan sistem yang paling sesuai dengan kebutuhan operasional bisnisnya. Yang penting, total jam kerja aktif tidak boleh melampaui 40 jam dalam satu minggu kerja. Ketentuan ini meliputi:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Istirahat harian<\/strong>: minimal 30 menit setelah bekerja selama 4 jam berturut-turut.<\/li>\n\n\n\n<li><strong>Istirahat mingguan<\/strong>: 1 hari untuk sistem 6 hari kerja, atau 2 hari untuk sistem 5 hari kerja.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Waktu istirahat tidak termasuk dalam hitungan jam kerja karyawan. Memastikan karyawan mendapat istirahat cukup berkontribusi langsung pada produktivitas jangka panjang.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Ketentuan Kerja Lembur<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Salah satu komponen penting dalam aturan jam kerja menurut UU Ciptaker adalah pengaturan lembur. Berikut poin-poin yang wajib dipatuhi perusahaan:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Persetujuan karyawan wajib diperoleh sebelum penugasan lembur dilakukan.<\/li>\n\n\n\n<li>Batas maksimal lembur adalah 4 jam per hari dan 18 jam per minggu.<\/li>\n\n\n\n<li>Upah lembur wajib dibayarkan sesuai ketentuan perundang-undangan yang berlaku.<\/li>\n\n\n\n<li>Perintah lembur harus disepakati secara tertulis antara perusahaan dan karyawan.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Perusahaan tidak diperbolehkan memaksakan lembur tanpa persetujuan jelas dari karyawan. Kegagalan mematuhi ketentuan ini dapat menjadi celah hukum yang merugikan perusahaan di kemudian hari.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Adapun UU Ciptaker juga telah menetapkan formula baku untuk menghitung upah lembur karyawan. Acuan dasarnya adalah: <strong>upah per jam = 1\/173 \u00d7 upah sebulan<\/strong>.
