Istilah PKWT merujuk pada hubungan kerja antara pekerja dengan pemberi kerja berdasarkan perjanjian kerja yang bersifat sementara. Dalam konteks ini, hubungan kerja akan berakhir ketika periode yang telah disepakati berakhir atau tugas-tugas yang ditentukan telah selesai. Lewat artikel ini kita akan membahas mengenai hak karyawan di-PHK, khususnya bagi karyawan kontrak atau PKWT.<\/p>\n\n\n\n<p><strong>Hak-hak Karyawan PKWT<\/strong><\/p>\n\n\n\n<p>Karyawan PKWT seringkali digunakan oleh perusahaan untuk memenuhi kebutuhan tenaga kerja yang bersifat sementara. Hal ini termasuk proyek jangka pendek, musim kerja tertentu, atau dalam rangka menggantikan pekerja tetap yang sedang cuti. Perlu diketahui pula bahwa karyawan dengan kontrak PKWT tidak perlu melalui masa percobaan <em>(probation)<\/em>. Bila pemberi kerja memberlakukan masa percobaan, maka kontrak awal batal secara hukum dan status kontraknya berubah menjadi PKWTT (Perjanjian Kerja Waktu Tidak Tertentu).<\/p>\n\n\n\n<p>Meskipun status mereka bersifat sementara, karyawan PKWT memiliki hak-hak yang dijamin oleh undang-undang.&nbsp; Beberapa hak utama yang dimiliki karyawan PKWT antara lain:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li><strong>Upah<\/strong><\/li>\n<\/ol>\n\n\n\n<p>Karyawan PKWT berhak menerima upah yang layak sesuai dengan perjanjian kerja. Upah ini tidak boleh lebih rendah dari upah minimum yang ditetapkan oleh pemerintah setempat.<\/p>\n\n\n\n<ol start=\"2\" class=\"wp-block-list\">\n<li><strong>Jaminan Sosial<\/strong><\/li>\n<\/ol>\n\n\n\n<p>Karyawan PKWT berhak mendapatkan jaminan sosial, seperti BPJS Ketenagakerjaan dan BPJS Kesehatan, yang merupakan bagian dari perlindungan pekerja di Indonesia.<\/p>\n\n\n\n<ol start=\"3\" class=\"wp-block-list\">\n<li><strong>Jam Kerja<\/strong><\/li>\n<\/ol>\n\n\n\n<p>Karyawan PKWT harus diperlakukan sama seperti karyawan tetap dalam hal jam kerja, cuti tahunan, dan lembur.<\/p>\n\n\n\n<ol start=\"4\" class=\"wp-block-list\">\n<li><strong>Hak atas Perlindungan<\/strong><\/li>\n<\/ol>\n\n\n\n<p>Karyawan PKWT berhak atas perlindungan dari diskriminasi, perlakuan yang tidak adil, dan pelecehan di tempat kerja. Mereka juga berhak untuk bekerja dalam kondisi yang aman dan sehat.<\/p>\n\n\n\n<ol start=\"5\" class=\"wp-block-list\">\n<li><strong>Tunjangan Hari Raya (THR)<\/strong><\/li>\n<\/ol>\n\n\n\n<p>Tak terkecuali, karyawan PKWT pun berhak memperoleh THR seperti halnya karyawan tetap.&nbsp;<\/p>\n\n\n\n<p><strong>Hak Karyawan di-PHK<\/strong><strong> Sebelum Masa Kontrak Berakhir<\/strong><\/p>\n\n\n\n<p>Ada kalanya perusahaan melakukan PHK terhadap karyawan PKWT sebelum masa kontraknya berakhir. Hal itu tentunya harus dilandasi oleh alasan-alasan yang sah menurut hukum. Berdasarkan undang-undang, beberapa alasan PHK dapat dilakukan adalah jika perusahaan melakukan peleburan, efisiensi, penutupan, atau pailit.&nbsp;<\/p>\n\n\n\n<p>Namun ketika karyawan PKWT di-PHK, ada hak-hak mereka yang harus dipenuhi oleh perusahaan. Sesuai ketetapan dalam UU Ketenagakerjaan dan UU Cipta Kerja, maka sebagai karyawan PKWT, hak-hak karyawan di-PHK antara lain:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li><strong>Ganti Rugi<\/strong><\/li>\n<\/ol>\n\n\n\n<p>Uang ganti rugi yang harus diberikan adalah sebesar upah pekerja sampai batas waktu berakhirnya perjanjian kerja.<\/p>\n\n\n\n<ol start=\"2\" class=\"wp-block-list\">\n<li><strong>Kompensasi<\/strong><\/li>\n<\/ol>\n\n\n\n<p>karyawan juga berhak mendapatkan uang kompensasi yang besarannya telah diatur berdasarkan jangka waktu PKWT yang telah diselesaikan oleh pekerja.&nbsp;<\/p>\n\n\n\n<p>Perhitungan uang kompensasi tersebut diatur dalam PP 35\/2021, sebagai berikut:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>PKWT selama 12 bulan terus menerus mendapatkan kompensasi sebesar 1 bulan upah.\u00a0<\/li>\n\n\n\n<li>PKWT selama 1 bulan atau lebih dan kurang dari 12 bulan dihitung secara proporsional dengan rumus: masa kerja\/12 x 1 bulan upah.<\/li>\n\n\n\n<li>PKWT lebih dari 12 bulan juga dihitung secara proporsional dengan rumusan yang sama.<\/li>\n\n\n\n<li>Besaran uang kompensasi untuk usaha mikro dan usaha kecil diberikan berdasarkan kesepakatan.\u00a0<\/li>\n<\/ul>\n\n\n\n<p>Jadi dapat disimpulkan bahwa karyawan PKWT memiliki hak-hak yang diatur dan dilindungi oleh undang-undang.
